Representative Experience

Advised project purchasers and investors on due diligence for clean energy projects, including BESS, DOER Clean Peak qualifications, and Clean Peak program incentive multipliers.

Established precedent for zoning protections for battery energy storage facilities. Won a Massachusetts Land Court case establishing that standalone BESS are protected under G.L. c. 40A, s. 3 from unreasonable local zoning restrictions because they facilitate the collection and use of solar energy, creating important precedent for future BESS projects throughout the Commonwealth.

Negotiated power purchase agreements, virtual power purchase agreements, leases, and PILOTs for museums, colleges, universities, municipalities and school districts looking to build clean energy on their campuses, meet sustainability goals, and satisfy regulatory requirements.

Advised developers and institutions regarding local renewable energy and sustainability requirements, including greenhouse gas emissions reductions and disclosure regulations (BERDO, BEUDO), green buildings, net zero carbon, and environmental and renewable energy requirements for large project permitting.

Counseled municipalities, utilities, developers, and permitting stakeholders on Massachusetts clean energy permit streamlining measures, including advice to the Commonwealth’s Commission on Energy Infrastructure Siting and Permitting through its Siting Practitioner Advisory Group.

Advised Massachusetts state agencies regarding acquisition and ground leasing of offshore wind port facility.

Negotiated leases and related agreements for landowners authorizing clean energy projects to be built on their property.

Counseled municipalities on community shared solar, municipal aggregation, and energy transactional matters, contract negotiations, and regulatory approvals.  We also advise municipalities on renewable energy bylaws, zoning overlay districts, procurement initiatives, and project review processes.

Negotiated EPC contracts on behalf of leading energy services and delivery company regarding major clean energy transmission project.

Counseled clients on emerging regulatory developments affecting renewable energy projects. Advised developers and energy companies regarding proposed revisions to MassDEP’s noise policy, updates to fire safety standards, and other evolving requirements affecting project siting, permitting, and operation.

Guided renewable energy projects through complex permitting and environmental review processes. Represent developers in securing local zoning approvals, wetlands permits, and related regulatory authorizations.
