Airports

Airport Planning, Development & Environmental

Issues of noise, air quality, wastewater contamination and other environmental factors can have a tremendous impact on airports’ expansion projects and facility development. Anderson & Kreiger’s leadership in environmental law integrates seamlessly with our specialized airport experience — and the revenue use and other grant assurance restrictions airports face when complying with environmental regulations.

We have counseled airports across the country on addressing a variety of environmental compliance challenges, including:

  • Per- and Polyfluoroalkyl Substances (PFAS)
  • National Environmental Policy Act (NEPA)
  • Fuel and Hazardous Material Cleanup
  • Flight Track Changes
  • State Environmental Reviews
  • Land-Use Regulations
  • Industrial Wastewater
  • Natural Resources Claims
  • Comprehensive Environmental Response, Compensation and Liability Act (CERCLA)
  • Superfund Regulations

ENVIRONMENTAL EXPERTISE MEETS AIRPORT EXPERTISE

We use our deep knowledge of federal and state environmental regulations to find creative and efficient solutions for airports. Our strategies take into account airports’ budget pressures, community relations, political landscape, and the many other components needed for successful and compliant capital and infrastructure initiatives, from runway expansions to master plan implementations.

When needed, we work closely with Anderson & Kreiger’s construction and insurance law teams, and collectively, we have helped airports recover millions of dollars from potentially responsible parties (PRPs) for fuel contamination. We also help to prevent airports’ risk exposure and liability through the inclusion of forward-thinking environmental indemnity provisions in fuel leases, and other agreements.

PFAS ENVIRONMENTAL COMPLIANCE

As PFAS contamination concerns increase, we have advised many airports on claims related to waste from firefighting aqueous film forming foam (AFFF).

Our PFAS guidance to smaller commercial airports in rural settings, including the Beverly, Nantucket, and Martha’s Vineyard airports in Massachusetts, centers around assessment, remediation, and drinking water protection programs. For larger airports, we are preparing clients for future regulatory interest in contamination claims.
